How does P.U.W.E.R.98 affect my Company?
If you are using any work equipment (e.g. machinery, tools, handling  equipment etc) then you are subject to the legal requirements of P.U.W.E.R.98.

How can I find out what I need to do to meet the regulations?

What will happen if I have a visit from an HSE Inspector and my machinery does not meet the regulations?
Generally an improvement notice will be issued giving specific time limits to make the machines compliant, or serious breaches the HSE may issue a prohibition order preventing use of the machinery in question. Failure to comply can lead to court action substantial Fines and even Prison sentences.  Remember you cannot insure against Fine.

My employees are all skilled men so are we exempt?
No one is exempt.

Do the guards need to have safety interlock switches?
It depends on the machine and its use. Your risk assessment will generally establish if interlocks are required.

Do I need to do Risk Assessments on all of my machinery?
Yes, it is a legal requirement that risk assessments are done on each piece of machinery and reassessed regularly or if a change occurs. Lack of a risk assessment or an inadequate risk assessment can lead to severe penalties.Solon Systems Limited will provide a Risk Assessment service on request (link to Risk Assessment).

I will not be able to do the job if guards are fitted so can I leave the machine unguarded?
No, their is a hierarchy under P.U.W.E.R.98 Regulation 11- Dangerous parts of machinery.  You must follow this hierarchy but it is generally not acceptable to choose the lowest actions e.g. PPE. Most machinery can be adequately guarded and Solon Systems Limited will advise on how this can be done to be the least intrusive and meet the legal obligations (link Machine guards).

The machines in my college D&T Workshop need to be upgraded but where do I find out what must be done?
The regulations and details of what must be fitted to the different types of equipment found in School, College, University & training establishments is found in British Standard BS4163:2000. Solon Systems Limited will advise and specify the equipment required to meet the legal regulations. (link Schools & colleges).

Does my woodworking machinery need guarding?
Yes- If they do not stop within 10 seconds then most pieces of woodworking machinery must be fitted with an effective braking system which is normally a DC Injection Brake. This should have been completed by December 2005. Details are available in the form of a free leaflet on the HSE web site. Physical guarding is also necessary on machinery such as saws, thicknessing planers, routers.   For advice contact Solon Systems Limited.
